Terms of Use

In short:

• Mindwtr is free and needs no account. Your data stays on your devices and in storage you choose, so keep backups.
• The source code is licensed under the AGPL-3.0, and these Terms do not change what that license lets you do.
• Sync providers, AI providers, and app stores are separate companies with their own terms.
• The software and our hosted services come without warranties, and our liability is limited.
• The Privacy Policy covers personal data.

1. About these Terms

These Terms of Use (“Terms”) apply to the Mindwtr website at mindwtr.app and docs.mindwtr.app, the official Mindwtr apps we publish (for example on the App Store, Google Play, the Microsoft Store, Flathub, and as direct downloads), and the small hosted services we run for those apps, such as the feedback and anonymous-analytics endpoints. “We”, “our”, and “us” mean the Mindwtr project, published by Dongda Li.

Mindwtr is free software with no account, so there is no “I agree” button. These Terms govern your use of our website, our official distributions, and our hosted services. If you do not agree to them, please do not use those services.

Three documents apply to Mindwtr. The AGPL-3.0 license covers the source code and what you may do with it. These Terms cover the website, the official apps as we distribute them, and our hosted services. The Privacy Policy covers personal data.

2. Open-source license

The Mindwtr source code is licensed under the GNU Affero General Public License, version 3.0 (AGPL-3.0). Nothing in these Terms limits the rights that license gives you, including the rights to study, modify, build, self-host, and redistribute the software under its conditions. If these Terms and the AGPL-3.0 ever disagree about the source code, the license applies.

App-store terms may also apply to downloads made through those stores. Nothing in these Terms or in applicable store terms is intended to restrict rights granted under the AGPL-3.0 or other applicable open-source licenses.

3. Using Mindwtr

You may use Mindwtr for any lawful purpose, personal or commercial. When using the website or our hosted services, you agree not to:

• attack, overload, probe, or disrupt the website or hosted services, or try to get access you are not meant to have;
• send the feedback or analytics endpoints forged, automated, abusive, or unlawful content;
• use the website or hosted services in a way that breaks a law that applies to you.

You must be old enough to enter into these Terms where you live. If you use Mindwtr on behalf of an organization, you confirm you may accept these Terms for it. We may block or limit access to the website or a hosted service for use that breaks these Terms. Nothing we do under these Terms affects the copy of Mindwtr on your device or your data.

4. Your data and backups

Your tasks, projects, notes, and attachments are stored on your own devices and, if you turn on sync, in a storage location you choose (for example a folder, WebDAV, Dropbox, iCloud, or a server you host). We do not host or store that data and have no access to it.

You keep all rights to your content. You are responsible for it, for the devices and storage you use, and for keeping backups. Mindwtr includes sync, backup, and recovery features, but no sync or storage system prevents every loss, and because we never hold a copy of your data we cannot restore it for you. Keep backups of anything you cannot afford to lose.

5. Optional third-party services

Sync providers, app stores, calendar services, and AI providers are optional and are not part of Mindwtr. Each has its own terms, prices, and privacy practices, which you agree to directly with that provider. We are not responsible for what those providers do or for whether they stay available. A provider may change or withdraw an interface Mindwtr relies on, and the related feature may stop working until we can update the app.

6. AI features and generated content

AI features are off until you turn them on. They use an API key you supply (“bring your own key”) or a model that runs on your device. Text produced by an AI model can be wrong. Review it before you rely on it; what you do with it is your responsibility. Your use of an AI provider is governed by that provider's terms and by any restrictions on the data you send it.

7. Analytics and privacy

Some official builds send a small anonymous daily heartbeat that you can turn off in Settings. What it contains, and everything else about personal data, is described in the Privacy Policy, which is part of these Terms.

8. Hosted services and support

The website, documentation, feedback endpoint, analytics endpoint, and any other service we currently host are provided without charge unless we state otherwise. We may change, suspend, or stop any of them at any time without notice. We offer support through the channels on the Support page as time allows, and we do not promise a response time or a fix.

If we ever offer a paid subscription or a paid hosted service, separate terms will describe what you get, prices, billing, cancellation, and refunds, and you will accept them when you sign up.

9. Donations

Donations are voluntary gifts that help keep the project going. They do not buy features, support, or priority, and they create no obligation on our part. They are not refundable except as required by applicable law or by the rules of the payment platform you used. The platform you choose (for example GitHub Sponsors) processes the donation under its own terms.

10. Trademarks and content

“Mindwtr” and the Mindwtr logo are marks used by Dongda Li for the Mindwtr project. The AGPL-3.0 gives you rights in the code, not in the name and logo. You may use them to refer to Mindwtr truthfully, for example to say that your build is based on Mindwtr. Please do not use them in a way that suggests we made or endorse something we did not. The brand page explains what is allowed. “Getting Things Done” and “GTD” are registered trademarks of the David Allen Company; Mindwtr is not affiliated with or endorsed by it.

Website source code, documentation, and other materials published in our public repositories are available under the license stated in that repository. Other artwork, screenshots, and materials remain subject to their own licenses or rights. Trademarks and logos of third parties belong to their owners.

11. No warranties

Mindwtr, the website, and the hosted services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that they will be available, secure, free of errors, or suited to your needs. This matches the warranty disclaimer in the AGPL-3.0. Where the law does not allow one of these exclusions, that exclusion does not apply to you.

12. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for damages arising from or related to Mindwtr, the website, or our hosted services, including indirect, incidental, special, consequential, or punitive damages and lost data, lost profits, or lost business, however caused and under any theory of liability, even if we were told such damages were possible. Where liability cannot legally be excluded, it is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, such as liability for fraud or for death or personal injury caused by negligence.

13. Changes

Mindwtr and its hosted services change over time, and features may be added or removed. We may also update these Terms. The date at the top shows the latest version, and the page history shows what changed. Using the website, apps, or hosted services after a change means you accept the updated Terms. If a change is important, we will say so on the website or in the app.

14. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise. If any part of these Terms is found unenforceable, the rest still applies.
